What is Foreclosure?

Did you know that the Bank does NOT own your home even though you have a mortgage against it? You were given the title when you bought your home. Its called a Deed. This is why the Bank must file a lawsuit against you to take your home as compensation if you stop making your loan payments. This legal action against you is called Foreclosure. 

You own your house and this is why the Bank must use the Foreclosure process.

Foreclosure Process

Here is what typically happens in the Indiana Foreclosure process. When you miss your first loan payment, you will likely get a courtesy call or letter from the Bank reminding you that you are late. The second missed payment will be a firm letter from the Bank requesting payment and the third will be a letter from the Bank’s attorney warning you about their intent to Foreclosure on your house. If you do not contact the Bank and make arrangements to bring your loan payments current, the Bank will file a Foreclosure lawsuit against you. The Bank will get a judgment against you and your house will be publicly sold at a Sheriff Sale. The whole process commonly takes 6 to 9 months. 

What Are Your Options?

If it becomes obvious that you won’t be able to keep your house, then you really only have three options. You can try to sell it. Keep in mind that you’ll need sufficient equity to cover all of the expenses including missed payments and attorney fees. You can simply let it go to Sheriff Sale which will destroy your credit and you will not be able to buy another house for about three years, or we can negotiate a Short Sale for you.
